If Fulton County District Attorney Fani Willis “does not recuse herself from this case by noon on Monday,” she will be sued by one of former President Donald Trump’s co-defendants in his Georgia election tampering lawsuit.
In response to allegations that he broke the law in an effort to overturn the Georgian presidential election results in 2020, Trump, the likely Republican nominee, has submitted a not-guilty plea to a number of counts.
In the midst of handling four criminal matters, Trump announces his candidature for a second term in government. Trump has always denied all of the charges levelled against him, claiming that they are all political in nature.
On X, the platform that was formerly known as Twitter, Harrison Floyd wrote: “I don’t want to put a black woman in jail.” However, I might be forced to exhaust all legal options if Fani Willis does not withdraw from this matter by Monday at noon. Restore greatness to Fulton.
“Part of an article allegedly from the Atlanta Journal-Constitution was posted by Floyd, indicating that Willis’s office disseminated a tape of a discussion Willis had with his lawyer, Carlos J.R. Salvado, regarding a separate criminal case in Maryland.” Newsweek reported.
According to Newsweek, recording a private conversation without both parties’ consent is punishable by up to five years in prison, a $10,000 fine, or both. This is in accordance with Maryland’s Wiretap Act. Outside of regular business hours, Newsweek reached out to the Fulton County District Attorney’s office for a response. The similar charge against Willis was levelled by Floyd’s lawyer Christopher Kachouroff on Tuesday in an interview with Phil Holloway.
With reference to Willis, he stated: “She did get in touch with us, one of my colleagues in Maryland, and she ended up recording him. He was handling the Maryland case, and I was handling the Georgia case. She was rude and abrupt with him on the phone.”
Holloway inquired of Kachouroff whether he was implying that Willis had made an illegal recording of the call., and he replied, “Oh yeah, it’s a felony in Maryland.”
In a separate X post on Wednesday, Floyd posted: “Fani Willis ILLEGALLY recorded a [phone emoji] call with my lawyer. It’s a felony! She is a DEI [diversity, equality, and inclusion] thug with a law license. Will anyone in GA stand up to her?”
Among Trump’s co-defendants, Floyd—who was formerly the head of Black Voices for Trump—is the only one who is incarcerated in the Georgia case.
Between August 24 and August 30, he was detained, and a $100,000 bond was posted. Judge Scott McAfee rejected the prosecution’s attempt to withdraw his bail in November 2023, citing his alleged “pattern of intimidation.”
A Fulton County court refused Trump and his co-defendants’ motion on Thursday. They were attempting to use First Amendment defences to get the Georgia election meddling case dismissed.
In his order denying the motion, Judge Scott McAfee wrote: “Even core political speech addressing matters of public concern is not impenetrable from prosecution if allegedly used to further criminal activity.”
The judge said that the indictment alleges more than just political statements.
“The State has alleged more than mere expressions of a political nature,” the judge wrote. “Rather, the indictment charges the Defendants with knowingly and willfully making false statements to public officers and knowingly and willfully filing documents containing false statements and misrepresentations within the jurisdiction of state departments and agencies.”
